Legal action loses fire

A court case has been dropped over the removal of a historical brick sawdust kiln in Kyneton.
The unusual kiln at Lauriston Reservoir Road was destroyed in January less one month after its significance was recognised for local heritage protection.
Macedon Ranges Shire Council began proceedings against the landowners of the property concerned in the Magistrates Court in October.
A council spokesperson said the initial hearing date was adjourned at the request of the land owners and would not now proceed.
Council’s director of planning and environment Angela Hughes told the Midland Express “council looks at each case on its merits and assesses further information as we receive it”.
“Unfortunately it would not be appropriate to disclose further information for reasons of privacy and confidentiality.”
She said the council was not pursuing the matter further and future matters of this nature would be considered case by case on their merits as a situation arose.
The kiln had been identified in the Gisborne and Kyneton Heritage Study 2017 as one of 36 places of in and around Gisborne and Kyneton that merit local protection under the Heritage Overlay within the Macedon Ranges Planning Scheme.
The heritage study called for repairs to joints of the kiln at the earliest opportunity and the openings at the rear of the structure to be closed off to access.
It was the sole remnant of the town’s once prosperous sawmilling industry and one of the last remaining in the state.
Kyneton Historical Society’s Larina Strauch said the outcome and loss of a piece of Kyneton’s past was disappointing.
“In light of the fact that it was rare kiln, it is disappointing to think that we have lost it from the landscape,” she said.
Sawmills were operating in the area from as early as 1859. The heritage study identifies just three other identical structures in the Mansfield Shire: the last known of their kind.
